Right to Delete

You have the right to request that Wetzel’s Pretzels of Augusta® delete any Personal Information we collected and retained, subject to certain exceptions. We may deny your deletion request if retaining the Personal Information is necessary for us or our service providers to:

  • Complete the transaction for which the Personal Information was collected, provide a good or service requested, fulfill obligations within an ongoing business relationship, fulfill terms of a warranty or product recall, or perform our contract with you.
  • Detect security incidents or protect against malicious, fraudulent, deceptive, or illegal activity.
  • Debug products to identify and repair errors that impair functionality.
  • Exercise free speech, ensure the rights of other consumers, or exercise other rights provided by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research when deletion would seriously impair the research, and you previously provided informed consent.

  • Make other internal and lawful uses compatible with the context in which information was provided.

Personal Information not subject to these exceptions will be deleted or de-identified, and we will direct our service providers and contractors to do the same.

Right to Opt-Out of Sale/Sharing

You have the right to opt out of the sale or sharing of your Personal Information.

Right to Correct

You have the right to correct inaccurate Personal Information collected about you. We may request documentation to verify your identity when necessary, as permitted by law.

Right to Limit

You have the right to limit our use or disclosure of your Sensitive Personal Information to certain purposes permitted by law. As explained above in the section titled Sensitive Personal Information, we only use and disclose Sensitive Personal Information as permitted by the CCPA, so this right may not apply in all cases.

Financial Incentives

The CCPA allows Wetzel’s Pretzels of Augusta® to offer certain financial incentives for providing your Personal Information, which may result in different prices or rates for our goods or services. Any financial incentive we offer will reasonably relate to the value of your Personal Information. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

If a financial incentive is offered, we will provide the details here, including how the incentive relates to your data, so you may make an informed decision about participation. Exercising Your Right to Opt-Out of Sale and Sharing

  • Opt-out settings are browser and device-specific. Returning from a different device or browser, or deleting cookies, requires re-applying your settings.

How We Verify Requests

  • We confirm receipt of your request within 10 business days. If you do not receive confirmation, contact us via toll-free number or web form.

  • To verify a request to know/access, delete, or correct Personal Information, we may match the information you provide with our records, send an email to the email on file, or request additional information. You must provide the requested information to complete verification.

  • Response time: We aim to respond to verifiable requests within 45 days, with an extension of up to 90 days if necessary, notifying you in writing.

  • Processing requests:

    • Know/Access: We provide a report of Personal Information collected, including data collected by service providers or contractors.

    • Delete: We delete your Personal Information and instruct our service providers, contractors, and third parties to do the same, subject to CCPA exceptions.

    • Correct: We correct inaccurate Personal Information and instruct service providers and contractors to correct it.

  • We notify you if we cannot verify your request. If verification fails, the CCPA prohibits deletion, correction, or disclosure of Personal Information.

  • Fees: No charge unless the request is excessive, repetitive, or manifestly unfounded. If a fee applies, we provide a cost estimate before processing.

  • Authorized agents must provide documentation (power of attorney, signed authorization, valid email for direct confirmation, etc.) to submit requests on a consumer’s behalf.

California Privacy Rights under the Shine-the-Light Law

Under California’s Shine-the-Light law, California residents can request free information about any Personal Information we may share with third parties for their own direct marketing. Requests may be made once per calendar year for the prior year.

Submit your request in writing to Wetzels.privacy@mtygroup.com with the subject line “California Privacy Information”, stating that you are a California resident and providing a current California address. We will respond to valid requests by sending the information to the email used to submit the request. Responses will be limited to covered sharing as required by the law.
